StoreOnCloud LLC, including our subsidiaries and affiliates worldwide (“StoreOnCloud”, “we”, “our” or “us”), puts great efforts in making sure that the personal data we process is safe and used properly, and that our data practices are accurately communicated to our prospects and users (“you”).
1. Data Collection
Such data may include: The data we process regarding our Prospects and Users is typically collected and generated through automatic means, directly from you, through your interaction with us or with our Services; or through third-party services, social media, analytics tools, events we organize or take part in, and other business initiatives.
- Contact information: contact details and interests, as well as any needs, preferences, attributes and insights relevant to our potential engagement;
- Direct interactions and communications with us: correspondence with us (e.g., for user experience, support and training purposes), as well as chats, surveys, feedbacks, calls and video recordings, transcriptions, and analyses thereof;
- Site usage information: connectivity, technical and aggregated usage data, user agent, IP addresses, device data (such as type, OS, device ID, browser version, locale and language settings used), approximate geolocation, activity, communication and performance logs, session recordings, issues and bugs, and the cookies and pixels installed or utilized on your device.
We collect additional data from our Users, such as:
- Account information: e-mail address, name and, when applicable, hashed password, phone number or other information used for authentication, access control and providing support;
- Payment information: mailing address, company name (if applicable), 4 last digits of the credit card number, expiration date, credit card type, or account details at payment processing services such as Stripe (if applicable), and payment preferences. To the extent that any of the foregoing solely relates to a non-human entity, we will not regard it as personal data, and this Privacy Policy will not apply to it.
- Service usage information: license key, server’s software, version and IP address, MySQL version, PHP settings and version, Magento version, site URL, number of custom templates saved to library, and number of widgets used.
2. Data Usage
StoreOnCloud processes the personal data described in Section 1 for the purposes listed below, as necessary for the performance of our Services; to comply with our legal and contractual obligations; and to support our legitimate interests in maintaining, improving and advertising our Services. These include understanding how our Services are used, and how our Services, campaigns and other activities are performing; gaining insights which help us dedicate our resources and efforts more efficiently; marketing, advertising and selling our Services; providing customer service and technical support; and protecting and securing our Services, ourselves and the organizations and individuals we engage with.
Specifically, we use your data for the following purposes:
- To facilitate, operate, enhance and provide our Services. We specifically note that in accessing certain third-party domains, per your instructions, we may conduct such access through your IP address, in order to ensure relevant and efficient access to public data. Please note that this activity may be tracked by Internet Service Providers. We will never use the IP address to access websites which may impact your ability to access the Internet;
- To provide you with assistance and technical support services, to test and monitor the Services, or diagnose or fix technology problems, and to train our staff;
- To personalize our Services, including by recognizing an individual and remembering their information when they return to our Services, and to provide further localization and personalization capabilities;
- To gain a better understanding on how individuals use and interact with our Services, which content and data they have processed through our Services, and how we could improve their and others’ user experience and the value they can generate from using the Services, so we could continue improving our products, offerings and the overall performance of our Services, including through the utilization and optimization of Artificial Intelligence and Machine Learning capabilities;
- To facilitate and optimize our marketing and advertising campaigns, ad management and sales operations, and to manage and deliver advertisements for our products and Services more effectively;
- To contact you with general or personalized service-related messages, or with promotional messages, in accordance with Section 8 below, and to facilitate, sponsor and offer certain events and promotions;
- To facilitate and optimize our marketing campaigns, ad management and sales operations, and to manage and deliver advertisements for our products and services more effectively, including on other websites and applications. Such activities allow us to highlight the benefits of using our Services, and thereby increase your engagement and overall satisfaction with our Services. This includes contextual, behavioral and interests-based advertising based on your activity, preferences or other data available to us or to our business partners;
- To support and enhance our data security measures, including for the purposes of preventing and mitigating the risks of fraud, error or any illegal or prohibited activity;
- To create aggregated statistical data, inferred non-personal data, or anonymized data, which we or our business partners may use to provide and improve our respective services, or for any other purpose; and
- To comply with our legal, regulatory, compliance and contractual obligations.
3. Data Retention
We retain your personal data only for as long as necessary to fulfill the purposes for which we have collected it. To determine the appropriate retention period, we consider the amount, nature and sensitivity of your personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means and the applicable legal requirements. We will also retain and use your personal information to the extent necessary to comply with our legal obligations, resolve disputes and enforce our policies. If you stop using our services or if you delete your account with us, we will delete your information or store your information in an aggregated and anonymized format.
4. Data Security
We and our Service Providers implement systems, applications and procedures to secure your personal data, to minimize the risks of theft, damage, loss of information, or unauthorized access or use of information. These measures provide sound industry-standard security, however, although we make efforts to protect your privacy and data, we cannot and do not guarantee the absolute protection and security of any personal data stored with us or with any third-parties.
5. Information Sharing
Our Services are possible because of a variety of Third-Party Product Providers. Sometimes it is necessary for us to share Merchant, Partner, or Shopper Personal Data with Third-Party Product Providers to support our Services and provide you with the core functionality of our Services. We may access, transfer, disclose, and/or retain Personal Data with consent, at your request, or in the circumstances described below.
- Compliance. If we have a good faith belief that doing so is necessary to: (i) comply with applicable law or respond to valid legal process, including from law enforcement or other government agencies; or (ii) protect the rights or property of StoreOnCloud, including enforcing the terms governing the use of the services.
- Protection. If we have a good faith belief that doing so is necessary to: (i) protect Merchants, Partners, Shoppers, or visitors; for example, to prevent spam or attempts to defraud us or users of our services, or in response to threats of safety of any person; or (ii) operate and maintain the security of our products, including to prevent or stop an attack on our computer systems or networks.
- Service Providers. StoreOnCloud may use from time to time a limited number of third-party service providers, data processors, contractors, and other businesses to assist us in providing our services for the purposes described in this Privacy Policy.
- Affiliates. We share Personal Data among StoreOnCloud-controlled affiliates and subsidiaries for the purposes described in this Privacy Policy.
- Payment Processing. We share payment data with banks and other entities that process payment transactions or provide other financial services, and for fraud prevention and credit risk reduction.
- SDKs and APIs. StoreOnCloud may include third-party libraries such as Software Development Kits (SDKs) or Application Interfaces (APIs) within our applications (including the Mobile App) for the purposes described in this Privacy Policy, including the following:
- Functional SDKs: these are software libraries we use to enhance the end user experience and functionality within the application, such as graphics and display of images within the app, and in-app notifications according to preferences.
- Analytics SDKs: these are external third-party sub processors’ libraries we use in collecting device and usage data for application performance monitoring.
- Your Interaction with Third-parties. When interacting with our Services you may be able to link or engage Third-Party Products such as third-party websites, services, social media networks, applications, or other third-party features. Enabling Third-Party Products may allow Third-Party Product Providers to access or process your Personal Data or enable StoreOnCloud to access data including Personal Data from those Third-Parties Product Providers. StoreOnCloud does not have control over, nor do we endorse, these Third-Party Products and we are not responsible for the privacy or security of any information you provide to Third-Parties Product Providers or request StoreOnCloud provide to Third-Parties Product Providers. We do not verify the application or its security or privacy practices. When interacting with Third-Party Product Providers, their respective privacy policy and other terms apply.
- Merger; Sale. We may also disclose Personal Data as part of a corporate transaction such as a merger or sale of assets.
6. Cookies and Tracking Technologies
StoreOnCloud and our Service Providers use cookies and other technologies for performance, tracking, analytics, personalization purposes and in order to provide you with a better experience. We may share non-identifiable/aggregated extracts of such information with our partners for our legitimate business purposes.
A cookie is a small amount of information that’s downloaded to your computer or mobile device (for example, Google Chrome or Safari) when you visit certain websites. We use a number of different cookies on the StoreOnCloud website, including strictly necessary, performance, advertising, and social media or content cookies. Some cookies are necessary to allow you to browse our website, use its features, and access secure areas. The use of these cookies is essential for the website to work. We also use functional cookies to remember choices you’ve made or information you’ve provided, such as your username, language, or the region you are in. This allows us to tailor your website experience specifically to your preferences.
Third party analytics cookies - we use Google Analytics and other third-party analytics providers listed below to help measure how users interact with our website content. These cookies “remember” what our users have done on previous pages and how they’ve interacted with the website. 7. Communications
We send certain important communications, such as account notices or changes or updates to our Services, to our users with an active storefront.
We may send promotional communications, such as new features, offerings or events, to existing and prospective Merchants, Partners, and visitors, by email, phone, and other channels.
8. Data Subject Rights
Under applicable law, you may have the ability to exercise certain rights over your Personal Data. You may have the right to request access to, correct, amend, delete, port to another service provider, restrict, or object to certain uses of your personal information. When collection is based on your consent, we attempt to provide you with notice at collection and the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal by applicable law.
Please also note that we may need to verify your identity by a method appropriate to the type of request you are making. We may also request that your authorized agent have appropriate written permission from you to make requests on your behalf, and we may also need to verify your authorized agent's identity to protect your Personal Data. We reserve any and all rights to decline requests to the extent permitted by applicable law.
